The mistake sellers keep making near campus

Here is how the conversation usually goes. A seller near App State calls me, and inside two minutes they tell me their house is a great student rental. Four bedrooms, close to campus, minutes to downtown Boone. They have a number in their head that assumes an investor will come along, fill every room, and pay for the privilege.

Then I ask which zoning district the house sits in. Nine times out of ten, we go pull it up on the Town of Boone’s interactive zoning map and the answer is a district that caps occupancy at one family or up to two unrelated persons. The house is four bedrooms. The legally-allowed occupancy is two roommates, not four. The premise of the price is wrong.

The Town of Boone spells this out plainly on the Good Neighbor Program page: “Most residential zoning districts allow up to 2 unrelated individuals, and unlimited family members to live in a single dwelling unit.” That is not a suggestion or a soft guideline. It is the ordinance. Fines run $200 per day, per violation for occupancy overages.

What Boone actually allows — parcel by parcel

Occupancy in the Town of Boone is regulated either by the zoning district the dwelling unit sits in or by the type of development approval the original developer received. That’s a critical caveat: two houses on the same street can carry different occupancy rules if they were platted differently. The town’s Housing, Neighborhoods, and Occupancy Information page lists four categories.

“Family” has a specific definition in the ordinance too. Individuals related by blood, marriage, domestic partnership, or adoption, occupying a premise and living as a single, non-profit housekeeping unit. Live-in help is fine. Roomers and boarders are not part of the family. Cousins alone are considered unrelated unless they are part of the same housekeeping unit with a parent, grandparent, or great-grandparent. A fraternity, sorority, club, rooming house, or group of students living together is not a family.

The bedroom rule is where sellers get most surprised: the ordinance requires at least one bedroom for every two unrelated occupants, and an efficiency dwelling unit counts as one bedroom. So the extra bedrooms in a four-bedroom house do not raise the occupancy cap. If your district allows two unrelated persons, two unrelated persons is the ceiling. The extra bedrooms are storage.

Whole-home short-term rentals and homestays

The town has been direct on Airbnb-style rentals. “In Boone, whole-home short-term rentals are not allowed in any residential zoning districts.” That is the language on the Good Neighbor page. The fine for violating that rule is $100 per day, per violation.

Homestays are allowed with an annual permit. The town defines a homestay as a lease of up to two bedrooms of a residence by its full-time resident, for stays of less than 30 days. The operator must be the full-time resident and must be present during the stay. Full-time resident means the property is the person’s primary home. Two documents of proof of residence — tax bill, lease, or utility bill — are required on the application.

The homestay permit also requires the operator or the operator’s agent to respond to complaints or emergencies within two hours at all times the rental is occupied. Parking has to work out too — one dedicated space per bedroom or one per two adult renters, whichever is greater, plus two for the dwelling itself. Insurance for the rental use is required. This is not a form you fax over and forget.

Neighborhood Conservation Districts — another layer

Some of the neighborhoods closest to campus sit inside a Neighborhood Conservation District overlay. There are currently eight NCDs on the town’s map: Beverly Heights, Blanwood Drive, Forest Hill Drive, Grand Boulevard, Grandview Heights, Junaluska, Queen/Green Street, and Stadium Drive.

Inside an NCD, additional requirements apply to rental properties beyond the base occupancy rule. Every tenant living in an NCD rental must file a Residential Parking Registration Form with Planning and Inspections. No more than two unrelated persons per dwelling unit will be issued parking stickers — even if your district technically allows more unrelated occupants, the stickers stop at two. And owners of rental property who live more than 50 miles from Boone are required to designate, in writing, a local managing agent who resides in Watauga County and handles all matters concerning occupancy. That agent’s name, address, and phone number goes to the Town Administrator.

NCDs are meant to preserve a low-density, family-oriented living environment and to protect existing property values. That intent shows up in the rules and in the enforcement. The App State housing picture drives the demand

App State enrolled 21,798 students in Fall 2025 — 19,732 undergraduates and 2,066 graduate students — according to the university’s official About page. That is a lot of housing pressure funneled into a small town. But the pressure does not translate directly into off-campus demand at every price point, because the university housing policy shapes it.

All students classified as incoming first-year are required to live in a residence hall for the entire academic year unless University Housing grants an exemption. Exemptions are narrow: married students, single parents, students 25 or older, military veterans, students living with a parent or legal guardian within 30 miles of campus, students in an App State Online program, or students at the Hickory campus. Everyone else lives in the residence halls their first year. That’s the university’s policy.

Transfer students who are more than a year out of high school are not required to live on campus and are not guaranteed a spot. On-campus housing offers go to first-years first, then to returning students, then to transfers by application date. Roughly one in four incoming transfers actually gets a bed on campus in a typical year, according to University Housing. Everyone else is off-campus.

Which means the actual off-campus rental market is sophomores, juniors, seniors, transfers who did not get on-campus space, and graduate students. That is still real demand. It is not the entire 21,798 enrollment.

What the family buyer weighs about proximity to campus

Family buyers who look at homes near campus are not evaluating the property with student-rental math. They are weighing what the same location does to their day-to-day life. Some of that is a positive: walkability to campus events, easy access to the Boone Greenway, membership in a community that hums during the school year. Some of it works against the seller: game-day traffic, parking scarcity, noise on football weekends, the visual mix of student rentals and long-term homeowners on the same block.

The trade-off shows up in a specific way. A family buyer values a location near a well-maintained park, a good school, and a stable neighborhood more than they value proximity to Rivers Street. If your house is in an NCD, and NCD rules are aggressively enforced against loud rentals, that actually raises the value for a family buyer even as it caps investor value. The same features that cool the investor market can warm the family market. The right listing describes the house honestly to the pool that fits.

How to price a Boone home near App State without the fantasy

Pick the pool. Pool one is the family buyer. Pool two is the legally-conforming investor buyer in a district that actually allows more unrelated persons, with the right bedroom count, on a bus route, ideally outside an NCD. These are not the same listing.

If your property lands in the family pool, describe it that way. Photograph it that way. Price it against family comps that closed in the same neighborhood in the last six months, without leaning on the “could be a student rental” premise. Highlight the school, the park, the parkway, the low-density character. Marketing to a fantasy investor pool leaves the house on the market longer and pushes you into a price cut anyway. The comps I’ve seen sit are almost always the ones that tried to be both.

If your property genuinely lands in the investor pool — more-unrelated district, right bedroom-to-occupant ratio, near a bus stop, and outside an NCD (or willing to price in the extra NCD compliance cost) — then price for that pool and market to the small number of local investors who understand the ordinance. That number is smaller than you think. There aren’t a hundred investors sitting on capital waiting for a four-bedroom on a family street. There are a handful who know the zoning cold and buy accordingly.

The number one thing sellers near campus should do before setting a price: call Town of Boone Planning and Inspections at (828) 268-6960 and confirm three things for the specific address. Which zoning district. Whether an NCD overlay applies. Whether any development approval on the parcel further restricts occupancy.
