That is a problem the day the buyer applies for financing — because the appraiser cannot count the space as a legal second unit, the lender cannot count rent income toward the buyers qualifying income, and the buyer inherits any code exposure the seller quietly left behind.

A county-approved Accessory Dwelling Unit is a different animal. The unit was built under permit, inspected by the local building department, issued a Certificate of Occupancy, and formally approved by planning as an ADU. That paper trail is what turns a nice space into a financeable asset.
